TERMS OF USE

These General Terms and Conditions (the ‘Terms’) apply to the website https://www.dominos.mt/ (“Website”) and govern the access and the use of the Website and our tablet and smartphone application ("App") by any user (the “User”, “Client”, or “you”), which is managed by Franchisology Limited  a company duly incorporated and registered in Malta, bearing company registration number C 65978, with its registered office situated at OneOneO, Pitkali Road, Attard ATD2214, Malta, VAT No. MT24762427 (hereinafter “Domino’s Pizza”, “we”, “us”, or “our”). It is important to read these Terms carefully.  Accessing the Website or App, shall be deemed to be your acceptance of these Terms and you are agreeing to be bound by these Terms as set forth below.   If you do not wish to be bound by these Terms, then you are kindly requested to leave the Website or App and refrain from making use of the Website or App. 

 

USER TERMS AND CONDITIONS OF USE

 

By accessing the Website or the App, you are agreeing that the Website and the App will only be construed according to the Laws of Malta.  Domino’s Pizza, makes no representations that the materials contained within the Website and the App are appropriate for locations outside of Maltese Islands i.e. Malta, Gozo and Comino, (the ‘Maltese Territory’).  Any and all information contained in the Website and the App, including but not limited to information regarding products and services, applies only to those provided or offered within the Maltese Territory. 

 

By accessing the Website or the App, you acknowledge and agree that your use is at your own risk and that none of the parties involved in creating, producing, or delivering this site is liable for any direct, incidental, consequential, indirect, or punitive damages, or any other losses, costs, or expenses of any kind (including legal fees, expert fees, or other disbursements) which may arise, directly or indirectly, through the access to, use of, or browsing of this site or through your downloading of any materials, data, text, images, video or audio from this site, including but not limited to anything caused by any viruses, bugs, human action or inaction or any computer system, phone line, hardware, software or program malfunctions, or any other errors, failures or delays in computer transmissions or network connections.

 

 

 

Domino’s Pizza, unilaterally and at its sole discretion, may revise, amend or update, in whole or in part, these Terms as well as the Privacy Policy  and any information contained on the Website or App, at any time and for any reason and without notice or obligation. Any amendments and updates to these Terms, and to the Privacy Policy, will be binding as soon as published on the Website or App. Users are therefore recommended to access and review, on a regular basis, these Terms and the Privacy Policy in order to verify the publication of the most recent and updated conditions.

 

The access and the use of the Website or App are available only and exclusively for personal use for the purpose of ordering Domino’s Pizza products (the “Products”) or to obtain the services made available by Domino’s Pizza and to obtain information on the same.

 

Domino’s Pizza will evaluate the fulfillment by the User of these Terms at its sole discretion. Any breach of these Terms may result in the withdrawal of the authorization to use the Website and/or the App, granted by Domino’s Pizza, at any time pursuant and in compliance to these Terms and this without prejudice to Domino’s Pizza’s rights of recourse available at law. 

 

The User agrees and undertakes to indemnify and hold harmless Domino’s Pizza, its affiliates and subsidiaries, as well as the relevant representatives, partners and employees, from any damages, liabilities, appeals or compensation requests, including legal defense expenses, resulting from the use of the Website or App by the User in any manner which is deemed by Domino’s Pizza to be in violation of or in breach with these Terms or with any law.

 

 

 

Contents and limitation of liability of Domino’s Pizza

Subject to the extent it is allowed by these Terms or by law, the User shall not copy, use, transfer, rent, sublicense, lend, amend, adapt, attempt to modify or alter the source code, make reverse engineering transactions, decompile, disassemble or otherwise operate, in whole or in part, the content of the Website or App. By accessing the website or App, the User assumes the risk that the content of the same may be incomplete, inaccurate, not updated, or that it may not satisfy its needs and requirements.

 

The User shall be solely responsible for the use of the Website and/or App and its contents and materials and for the information and data inputted on the Website and/or the App. Domino’s Pizza shall not in any way be held responsible for the use (if any) of the Website and/or App by the User, which is deemed to be in breach of any law. 

 

Although the contents, including but not limited to, the specifications, features, illustrations, equipment, and other information contained on the Website or App are based on up to date information, accuracy cannot be guaranteed and Domino’s Pizza makes no warranties or representations as to their accuracy and therefore the User should evaluate the contents and information found on the Website and/or App and Domino’s Pizza shall not be deemed or held responsible, in any case and for any reasonwhatsoever,neitherforanyinaccuraciesanderrors,norfordamages (if any) resulting, whether directly or indirectly, as a result of such User’s reliance on the contents and information on the Website or App.

 

The Website or App and all the information and contents published therein may be amended by Domino’s Pizza from time to time and without prior notice.

 

The User shall be solely responsible for any damage resulting to them or their property as a result of any material downloaded or otherwise obtained through the Website or App.  Domino’s Pizza makes no warranties and disclaims any liability for damages (if any) that may arise from the inability to access the services on the Website or App, or from damages (if any) caused by viruses, damaged files, errors, omissions, service interruptions, content cancellations, issues related to the web, providers, telephone and/or telematics connections, unauthorized accesses, data alterations, or missing and/or defective functioning of the User’s electronic devices. This list is intended to be indicative and should not be considered as being exhaustive.

 

The User is responsible for safeguarding and using their personal information correctly, and they are also accountable for any negative consequences, prejudice or harm that may occur to Domino’s Pizza or third parties due to the incorrect use, loss, or theft of such information.

 

During the registration process, it is the responsibility of the User to safeguard and utilize their login credentials for accessing reserved services. The User must select a unique user ID and password and provide accurate and up-to-date information. It is strictly prohibited for the User to choose a user ID that belongs to another individual with the intention of impersonating them, or to use someone else's user ID without explicit authorization. The User is accountable for maintaining the confidentiality of their password and must refrain from sharing it with any third parties. The User bears full liability for any actions carried out through their account, whether directly or by third parties authorized by the User. In the event of any abusive, fraudulent, or illegal use, Domino's Pizza reserves the right to immediately revoke the User's license at its sole discretion. Domino's Pizza has implemented appropriate technical and organizational measures to ensure the security of its services on the Website or App, safeguard the integrity of data related to electronic traffic and communications, and mitigate risks associated with unauthorized use, dissemination, destruction, or loss of data and both confidential and non-confidential User information. However, it is important to note that Domino's Pizza cannot guarantee the absence of viruses or elements that may have adverse effects on the technology or hardware of the Website or App.

 

 

Access to the Website or App, Interruption and suspensions

Domino’s Pizza will make every effort to ensure continuous and uninterrupted access to the Website or App. However, there may be instances where access to the Website or App is suspended, limited or interrupted.  Additionally, periodic limitations may be imposed on access to facilitate restoration, maintenance or the introduction of new functionalities or services. Domino’s Pizza will strive to restore access as promptly as possible. Furthermore, Domino’s Pizza reserves the right to block access to any material and/or to remove any material that, in its sole and absolute discretion, may violate or be deemed to violate these Terms. Domino’s Pizza also reserves the right to close the account of any User who violates these Terms. This includes instances where it is determined that the User is using proxy IP addresses to conceal the use of multiple registration accounts or falsely represent their location.  Any actions that disrupt the functioning of the Website or App in any manner are also subject to account closure. 

 

Personal data protection

Domino’s Pizza has in place a separate Privacy Policy regulating privacy practices for the Website and the App.  Domino’s Pizza strongly advises all Users to carefully review the Privacy Policy, which constitutes an integral part of these Terms.  This will enable all Users to comprehend the methods by which the Website or App collects and processes the User’s personal data, as well as the purposes for which it is used and processed.

 

Intellectual property rights

The Website or App and its whole content, including but not limited to, articles, opinions, other texts, lists, guides, photos, figures, pictures, video and audio clips and marketing texts, as well as marks, logos, domains names, firms or service marks and any other material that may be subject to property rights (including the source codes) and/or any other form of intellectual property (hereinafter, together, “Material/s”), are property of Domino’s Pizza or its successors in title, and are protected by national laws governing copyright, trademarks, marketing, and other laws, as well as international treaties. Nothing in these Terms and/or in the Website or App shall be interpreted as granting an implied license or right to use any Material without the prior written consent of Domino’s Pizza, its successors in title, or the third party owning the Materials or intellectual property published on the Website or App.

Unauthorized use, copying, reproduction, modification, republication, updating, downloading, mailing, transmission, distribution, duplication, or any other abusive use of the material is strictly prohibited.. The User agrees not to use the Materials for illegal purposes or infringe upon Domino’s Pizza’s rights.

Nevertheless, the User may view and display the content of the Website or App and/or the Material on the screen of a computer, store it in electronic form on a disk (excluding servers or memory devices connected to a web), or print a copy of for personal, non-commercial use, provided that all copyright and intellectual property rights notices are preserved. 

Accessing the Website or App does not grant any user rights to the content provided by Domino’s Pizza.

 

The Materials featured on the Website or App are copyrighted by Domino's Pizza and are protected by the Copyright Act, Chapter 415 of the Laws of Malta, policies, regulations, and international agreements. These copyright Materials may be downloaded, displayed, and reproduced in an unaltered form (retaining this notice) for personal, non-commercial use or internal circulation within an organization.

 

By accessing the Website or App, you acknowledge and agree that any Material contained therein is owned or licensed by Domino's Pizza and may not be used without prior written approval. Domino's Pizza will enforce its intellectual property rights to the fullest extent of the law. Sound, graphics, charts, text, video, information, or images of places or people either belong to Domino's Pizza or are used on the Website or App with permission. Your use of any of these Materials is prohibited unless specifically provided for on the Website or App. Any unauthorized use of the Materials may result in penalties and/or damages, including but not limited to those related to trademark infringement, copyright infringement, privacy rights, and publicity rights. Authorization to reproduce Materials from any linked sites to the Website or App, must be obtained from the respective copyright holder. In the event that the Website or App includes links to third parties’ websites and resources provided by third parties (“Other Websites”), such  links are provided solely for informational purposes and  User convenience. Domino’s Pizza has no control over  Other Websites and therefore cannot be held liable for their content, products, or any associated damages.   This includes processing of personal data and references to social networks such as Facebook.  The User should be aware that accessing any of these Other Websites through any of the provided links is done at their own risk.  It is recommended that the User exercises caution and carefully review the Terms and Privacy Policy of these Other Websites or Apps before connecting to them through the links on the Website or App. 

 

User's Representations and Warranties

The User represents and warrants that:

  1. They have read and fully understood these Terms;
  2. They will not engage in any commercial exploitation of the Website or App, its contents, or any part thereof, including reproducing, duplicating, copying, selling, reselling and/or using Domino’s Pizza Materials; 
  3. they will not publish or use false, libelous or defamatory data;
  4. they will not engage in any lawful or non-compliant use , direct and/or indirect, of the services and of the Website or App;
  5. they will not distribute any viruses, spyware, adware, rootkits, backdoors, Trojans or other similar IT threats; and

they will not use software or any other automated or manual means to copy or access the pages and content of the Website or App.

Acceptance of the Sale

 

Upon acceptance of the corresponding order by Domino’s Pizza, even if partial, the sale is considered to be executed.  By placing an order through any of the available methods, the User confirms that they have reviewed all the information provided herein and/or during the purchase process and fully agrees to the following terms and payment conditions.

 

All sales made through the Website or the App are subject to availability and acceptance by Domino’s Pizza. 

 

We reserve the right to refuse or cancel any order at our sole discretion.

 

Prices displayed on the Website or App are indicated in the local currency and are inclusive of applicable taxes, unless otherwise stated. 

 

Payment for orders must be made in full at the time of purchase or upon delivery, and we accept various payment methods for your convenience.

 

Once an order is placed, the User will receive a confirmation email with the details of their purchase.  Please review this confirmation carefully and contact our customer support service immediately if any discrepancies are found. 

 

We are committed to ensuring the quality and freshness of our products, and we take all necessary measures to maintain high standards of food safety and hygiene. 

 

By completing a purchase on the Website or the App, you agree to comply with all applicable laws and regulations regarding the sale and consumption of our products. 

 

Alcoholic Beverages

 

Upon completion of the purchase process through the Website or the App, the User acknowledges and explicitly agrees that they must be at least eighteen years old to purchase alcoholic beverages.  By placing an order that includes alcoholic beverages, the User expressly declares and guarantees that they are of legal drinking age.  Domino’s Pizza reserves the right to verify and confirm the User’s age during the delivery process.  If the User fails to meet the age requirement, the delivery of alcoholic beverages will not take place. 

 

Any rights of the User, including but not limited to compensation or reimbursement, as well as any contractual or non-contractual liabilities for direct or indirect damages to persons and/or property resulting from the non-acceptance of an order, in whole or in part, by Domino’s Pizza, are hereby excluded. 

 

 

Purchase Methods

The Client may only purchase products that are listed in the electronic catalogue available at the time of order dispatch on the Website and App.  The details of the products are described in the relevant informative forms. Please note that any accompanying images of the products may not perfectly represent the actual features of the product, including color, dimensions, and ancillary items being shown for marketing purposes. The purchase supporting information provided is generic and not specific to individual products.  If the Client requires further information, they can contact Domino’s Pizza using the specified contacts indicated in these Terms, the date and time of the order, and a client order number for future communication with Domino’s Pizza.  Once the order is received, Domino’s Pizza will send a confirmation email to the Client’s provided email address. . This email will include a copy of the terms and conditions of sale,, date and time of the order. and a “Client’s Order Number”, for future communication with Domino’s Pizza.  The Client is responsible for verifying the accuracy of the order details and promptly communicating any amendments if necessary, following the procedure outline in these Terms.  If Domino’s Pizza rejects or does not accept the order, they will promptly inform the Client of this circumstance.

 

Prices

 

Whilst we endeavor to ensure correct pricing online, including updating pricing, the actual amount charged upon delivery might differ from the one shown online because the prices stated on the Website  or the App, may vary either above or below from the prices at the outlet on the day your order is placed.  In any event, we will only charge the quoted price for the products that are actually delivered. 

 

The prices indicated on the Website and/or the App are inclusive of VAT. 

 

The price of the items does not include the delivery charge, which will be charged for at the rate specified when the order is placed. 

 

 

 

 

 

Offers

 

Any advertised promotions or offers will only be applicable for the duration and time frames, specified in the relative offer.  When ordering online, it is important that you choose the delivery dates and times which are applicable to the relevant offer as otherwise the relevant offer will not be applicable and any freebies will not be given and you will be charged at the normal prices. 

 

Domino’s Pizza reserves the right to launch competitions, offers or promotions either to online customers only or to in-store purchases only.

 

All offers are subject to availability and until stocks last.     

 

Availability

 

If for any reason beyond our control, we are unable to supply a particular item, Domino’s Pizza will not be in any way held liable to you.  To ensure availability of all our products, Domino’s Pizza reserves the right to limit your order to a maximum number of items. 

 

 

Payment methods and processing of transactions

 

Payment of any purchase including expenses, such as delivery, may be carried out by the following payment methods: 

 

  1. Debit or Credit Card

Payment is effected by entering your card details on our payment section, enabling Domino’s Pizza to process the order. We accept VISA and MasterCard.  Recognizing the importance of the security of electronic payments, EveryPay is a licensed Payment Institution by the Bank of Greece (decision no. 280/3/23-7-2018 Official Gazette B 3010/25-7-2018), and securely manages data card payment transactions, according to the regulatory framework of the card transaction security management standard. EveryPay is certified according to the card transaction management security standard (PCI DSS), and is subject to periodic audits by a specialized consulting company. All EveryPay services are done through secure connections with 256 bit SSL certificates. EveryPay also supports the possibility of using the 3D Secure service, an additional security layer for VISA & MasterCard cards. The User will then have to enter his personal secret code to successfully complete the transaction. 

In the event that the relevant purchase is carried out with the payment modalities by Credit or Debit Card, at the same time of the execution of the online transaction, the relevant banking institute will pre-authorize the total amount related to the purchase made and is put on hold in your account until the execution of the final transaction. The pre-authorisation does not constitute the transaction itself, but an authorization for the funds to be transferred. During this time the funds are not withdrawn from your account.   The amount related to your order, in whole or in part, will be actually debited on the User’s Credit or Debit card upon the execution and acceptance of the relevant order by Domino’s Pizza. The User will receive a receipt and the funds on the receipt will be withdrawn by way of a transaction. 

In the event of an order’s cancellation by Domino’s Pizza, Domino’s Pizza will simultaneously request the payment institution the cancellation of the transaction and the release of the pre-authorised amount. The release timeframe, depends exclusively on the banking institute and may take up to 24 days for the transaction to be cleared.  Such timing may vary depending on the card issuer.  The User agrees and expressly accepts that Domino’s Pizza  shall not be held liable for any direct or indirect damages caused by a delay in the clearance of the transaction by the banking institute.

 

Domino’s Pizza reserves the right to require the User’s contact information (i.e. a fix telephone No.) or the dispatch of a copy of the documents proving that the Card used is owned by the same User. In default, Domino’s Pizza reserves the right not to accept the relevant order.

 

Domino’s Pizza will not, at any time during the purchase procedure, be privy to the information related to the User’s Credit/Debit card, being transmitted through a protected connection directly to the website of the banking institute managing the transaction. No IT archive of Domino’s Pizza will store such data. Therefore, in no event, shall Domino’s Pizza be held responsible for any libelous and illicit use of Credit/Debit cards by third parties as of the payment of the goods purchased.

 

  1. Cash on delivery

The relevant payment of the full amount of your purchase, will be done in cash when the delivery of your purchase is made at the provided address. 

 

 

Carry Out and Delivery

 

Carry Out

 

A confirmation by email including a receipt will be sent to you confirming that the purchase is ready for collection at the chosen outlet at the time slot chosen. It is advisable to wait for the confirmation email before making your way to the outlet to collect your purchase. Upon collection of the purchase, you will be asked to present the confirmation email and order number. 

 

Carry Out is only available during the times and dates indicated on the Website or App corresponding to the outlet the carry out will be occurring from. No carry out service will be allowed outside of the prescribed times.    The opening hours could vary depending on the relevant store.  Domino’s Pizza reserves the right to alter carry out times at its sole discretion. Carry out service availability will be indicated on the Website and the App and therefore, it is important to check the carry out service times before placing an order. 

 

 

Delivery

 

Delivery is only available for orders above €15 including VAT (where applicable). 

 

Delivery service is available in the areas specified on the Website or App only.  If the order is placed from the Birkirkara, Qawra or Fgura outlet, delivery is available Monday to Sunday from 11:00 hrs to 22.00 hrs. The opening hours could vary depending on the relevant store.  Domino’s Pizza reserves the right to alter delivery times at its sole discretion. Delivery service availability will be indicated on the Website and the App and therefore, it is important to check the delivery times before placing an order. 

 

Delivery is made to the address specified by the User and at the time agreed with the User at the time of making the purchase/placing the order.  For deliveries to a residential apartment block, delivery is done at ground floor level at the main entrance door of the apartment block.  For deliveries to a business/hotel address, delivery is done at the ground floor entrance/reception of the business/hotel address.   

 

 

 

Domino’s Pizza shall not be held responsible for delays in handling the order or in delivering the ordered goods, in full or in part, due to circumstances beyond our control.

 

The User shall be solely responsible to control and verify that the number and the nature of the products being delivered correspond to the receipt sent by Domino’s Pizza by email; The User shall immediately inform Domino’s Pizza of any discrepancies in the products delivered with the purchase made.

 

If we attempt to deliver your order to the delivery address as agreed with you but there was nobody at the delivery address to accept your order, the driver will leave a notification of the attempted delivery and you need to contact our customer service to re-arrange delivery.  In these circumstances, if we have to return to deliver the order, a further charge may become payable. 

 

If it is impossible to deliver the order to the address specified by you for reasons out of Domino’s Pizza’s control, the ordered goods will be returned to the sale points of Domino’s Pizza. Domino’s Pizza will inform you that the delivery could not take place due to unforeseen circumstances and you need to contact our customer service to re-arrange delivery or carry out. 

 

Wolt Service

Domino’s Pizza has teamed up with Wolt for the delivery of orders. Please access the following User Terms of Service – Wolt (Malta) -  https://explore.wolt.com/en/mlt/terms, or any other link that may be available from time to time, and carefully read the applicable terms of services relating to the service provided by Wolt, as the same may be amended or substituted from time to time.    

 

Returns, Refunds and Withdrawal right

 

Once the order has been submitted and the payment has been authorized, it is not possible to modify or cancel the order and the User will not be entitled to any refund. If  the User wishes to modify or cancel an order, they may contact Domino’s Pizza following the procedure specified hereunder, which will attempt to block the relevant order. If the order has already been accepted by Domino’s Pizza and is already being prepared, the order may not be cancelled and the User will have no right/claim for a refund of all or part of the order. 

Without prejudice to anything contained herein, the following instances shall not, at any time, carry a right of withdrawal and/or refund.  Once the below products have been ordered and payment has been executed by the User, the User shall be liable to pay for the below products, irrespective of whether the User accepts delivery thereof or otherwise refuses to accept delivery of the product. 

    1. order of tailored or clearly personalized products;
    2. order of products that risk to deteriorate or to expire quickly, including but not limited to all alimentary products, alcohol and/or drinks;
    3. order of sealed products that could not be returned for hygiene reasons or reasons connected to the health protection or that have been opened after delivery.

 

The above list in indicative and non-exhaustive. Domino’s Pizza reserves the right to refuse returns, withdrawals, cancellations and refunds, in whole or in part, at its sole discretion, to any other instance/product as it may deem appropriate to do so on a case-by-case basis.     

 

Refunds may be requested for orders in which the food is wrong or omitted.  Refunds are granted at the sole discretion of Domino’s Pizza, after it has verified and determined that the food ordered and the food delivered are not the same.  Refunds are not typically provided for food that you simply do not like or are dissatisfied with.

 

Additionally, we cannot provide any refund if you change your mind or mistakenly order an item after the order is confirmed by Domino’s Pizza.

 

A request for refund of an order, in whole or in part, is to be submitted to Domino’s Pizza through the Website or App on [email protected], to the outlet in which the order was placed, specifying the reasons for the refund request.

 

Unless otherwise required by law, all requests for refunds must be submitted within 24 hours after placing the order. The original receipt must accompany all refund requests.  Refunds will be issued only if the request is justified and based on valid reasons.  Refunds will be issued to the same card that was used in the original purchase.  If the order was paid by cash on delivery, the amount equivalent to your refund amount, will be credited to your profile with Domino’s Pizza and may be utilized against future orders. 

 

No refund will be due to you by Domino’s Pizza if you fail to submit requests within the time limit set forth above or fail to provide any valid reason for your requests. 

 

 

Information and Complaints

If for any reason you are not satisfied with the quality of our products or service and wish to make a complaint, you are kindly requested to get in touch with us  by e-mail to the address [email protected]. When submitting a complaint, you will need to produce your confirmation and delivery receipt as proof purchase. 

 

Miscellaneous

In the event that any part of these Terms is adjudicated by a court of law, to be invalid, that specific part shall be considered null and void, while the remaining clauses will remain valid and enforceable.

 

These Terms are governed by the Laws of Malta. In the event that the parties are unable to reach a mutually agreeable resolution, any claims and disputes regarding the interpretation, implementation and/or application of these Terms, shall be definitively settled in the Courts of Malta, with an express waiver of any other jurisdiction.
